Self-Proving Will: In Texas, if a will includes a self-proving affidavit signed by a notary public, in addition to the 2 witnesses required to create a valid will, then the process for probating the will after the testator’s death is simplified in that witnesses will not have to appear in court to prove the validity of the will.

Independent Administration: Independent administration is widely used in Texas and allows an executor to administer the estate with minimal court supervision. Minimizing court oversight makes the executor’s administration of the estate much easier and more efficient.

Testamentary Trust: a trust within a will, which does not go into effect until the will is probated

No Contest Clause: a provision designed to prevent beneficiaries from contesting the will
